Roomzy is concerned about the usage by consumers, and has provided this Terms of Use statement (hereinafter referred to as “TOU”) to familiarize the user with it.
Acceptance of Terms
The services that Roomzy provides to its users are subject to the following TOU. Roomzy reserves the right to update the TOU at any time without any prior notice.
A. This Agreement, which incorporates by reference other provisions applicable to use of Website, including, but not limited to, terms and conditions set forth hereof governing the use of certain specific material contained in Website, sets forth the terms and conditions that apply to use of the Website by User. By using any and all services provided by Roomzy, the user agrees to comply with all of the terms and conditions provided. The user is responsible for all use of User’s Account (under any screen name or password) and for ensuring that all use of User’s Account complies fully with the provisions of this Agreement. User shall be responsible for protecting the confidentiality of User’s password(s), if any.
B. Roomzy shall have the right at any time to change or discontinue any aspect or feature of the Website, including, but not limited to, content, hours of availability, and equipment needed for access or use.
Changed Terms
Roomzy reserves the right, at any time, to introduce new terms and conditions, including but not limited to fees and charges for usage, or to amend or modify the terms and conditions that apply to the User's use of the Website or any portion of it. Any notice of such alterations, revisions, additions, or deletions must be given promptly. This notice may be sent by any method available to the user, including but not limited to publishing on the website, sending an email or regular letter, or by any other method. User's use of the Website following such notification will be considered User's acceptance of any updates, additions, or alterations.
Description of Services
Roomzy offers a range of resources and services via its website, including the ability to list one's own property for rent or lease, post one's own requirements for a home or property for rent or lease, prepare rental agreements, collect security deposits, and collect monthly rent. The TOU governs the services, including any upgrades, modifications, new features, and/or the creation of any new Website.
User Conduct
A. The user may only use the website for legitimate purposes. The user is prohibited from posting or transmitting any content on the website that violates or infringes upon the rights of others, is illegal, threatening, abusive, defamatory, invading another person's privacy or publicity rights, vulgar, obscene, profane, or otherwise objectionable, or that encourages behavior that would be illegal, subject to civil liability, or otherwise illegal. Users will not be allowed to engage in any behavior that, in Roomzy's opinion, prevents or hinders another user from using or enjoying the Website. The user agrees not to use the website for any commercial purposes, including but not limited to requesting users to subscribe to other online information services that are rivals of Roomzy.
B. The entire contents of Roomzy's website are protected by copyright as a collective work under the trademark and copyright laws of India. This includes text, software, images, videos, graphics, music, and sound, among other proprietary information and copyrighted material. Both the original content and the selection, organization, arrangement, and improvement of such content are protected by copyrights owned by Roomzy. Users are not permitted to alter, publish, transmit, take part in the transfer or sale, make derivative works, or use any part of the content for commercial gain.
C. User shall not upload, post or otherwise make available on Website any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right and the burden of determining that any material is not protected by copyright rests with User. User shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission.
Use of Services
In order to facilitate user-to-user contact, the Services may include email services, chat rooms, forums, personal profile pages, images, and/or other message or communication tools (collectively referred to as "Communication Services"). Users consent to using the communication services exclusively for the purpose of posting, sending, and receiving content that is appropriate and, when relevant, relevant to the specific communication service.

In its sole discretion, Roomzy retains the right to review content uploaded to the communication services and to remove any content. Roomzy retains the right, at any time and without prior notice, to terminate User's access to any or all of the Communication Services for any reason. In addition to the right to edit, refuse to post, or remove any information or materials, in whole or in part, at Roomzy's sole discretion, Roomzy also reserves the right to disclose any information at any time as it thinks necessary to comply with any applicable law, regulation, legal process, or governmental request.
When providing any personally identifying information in any Communication Service, Users are cautioned to proceed with caution. Roomzy expressly disclaims any duty with regard to the Communication Services and any actions resulting from User's involvement in any Communication Services since Roomzy does not control or endorse any of the messages, material, or information found in any of the Communication Services. As unofficial representatives of Roomzy, managers and hosts' opinions do not always align with Roomzy's.
Passwords, Member Accounts, and Security.
If opening an account is required for any of the Services, User must finish the registration process by giving Roomzy up-to-date, accurate, and full information as requested by the relevant registration form. The user will select a user name and a password as well. The user bears complete responsibility for keeping their account and password private. Additionally, User bears full responsibility for all actions taken using User's account. In the event that User's account is used without authorization or there is another security breach, User promises to contact Roomzy right away. Roomzy disclaims all responsibility for any damages User may suffer as a result of someone else using User’s password or account, either with or without User’s knowledge. In addition, the user could be held liable for losses incurred by Roomzy or another party due to someone else using the User's account or password. Users may not use anyone else’s account at any time, without the permission of the account holder.
Disclaimer regarding Software, Documents and Services available on this Website
When it comes to contract disputes, negligence, or other tortious actions arising from or connected with the use of software, documents, services provided or not provided, or information obtained from the services, Roomzy and/or its suppliers shall in no case be liable for any special, indirect, consequential, or other damages, or any damages at all resulting from loss of use, data, or profits.
Details provided to Roomzy or Posted at any of its Websites
The materials that users submit to Roomzy (including suggestions and feedback) or post, upload, input, or submit to any of its affiliated services are not attributed to Roomzy and are not available for public or private community members to review (each a "Submission" and collectively referred to as "Submissions"). But by uploading, posting, providing, inputting, or submitting (“Posting”) User's Submission, User grants Roomzy and its affiliated companies permission to use User's Submission in the course of operating their online businesses, including the right to reproduce, edit, translate, and reformat User's Submission; to publish User's name in conjunction with User’s Submission; and the right to sublicense such rights to any supplier of the services
Disclaimer of Warranty; Limitation of Liability
A. The user clearly acknowledges that using the website is at the user's own risk. The Website will not be uninterrupted or error-free, and Roomzy, its affiliates, and any of their respective employees, agents, third-party content providers, or licensors do not guarantee such a thing. Neither do they guarantee the outcome of using the website, nor do they guarantee the accuracy, dependability, or content of any information, service, or product offered through the website.
B. Except from those implied by and incapable of being excluded, restricted, or modified under the laws applicable to this Agreement, the Website is provided on a "As is" basis without warranties of any kind, either express or implied, including but not limited to warranties of title or implied warranties of merchantability or fitness for a particular purpose.
C. This disclaimer of liability covers any losses or harm resulting from any computer virus, communication line failure, failure of performance error, omission, interruption, deletion, defect, delay in operation or transmission, theft or destruction, or unauthorized access to, alteration of, or use of record, whether for tortious behavior, negligence, breach of contract, or under any other cause of action. The user expressly agrees that Roomzy is not responsible for the offensive, unlawful, or defamatory actions of other users or third parties, and that the user bears full liability for any harm resulting from the aforementioned.
D. In addition to the terms mentioned above, Roomzy disclaims all liability for any errors, inaccuracies, omissions, or other defects in the information contained on the website, as well as for any other claims or losses resulting from or caused by such information, regardless of the cause or duration.
Unsolicited Idea Submission Policy
Unsolicited suggestions, such as those for new advertising campaigns, promotions, products or technology, procedures, materials, marketing strategies, or product names, are not accepted or taken into consideration by Roomzy or any of its employees. Kindly refrain from sending any samples, demos, or other works that are not original and innovative. This policy's only goal is to prevent any miscommunications or disagreements when Roomzy's goods or marketing techniques appear to be copies of concepts that Roomzy has received. We ask that you refrain from sending us unsolicited ideas, but in the event that you do, please be aware that Roomzy cannot guarantee that your submissions will be kept private or proprietary.
Monitoring
Roomzy may, but shall not be required to, monitor the chat rooms and forums on the website in order to assess compliance with this agreement and any other operating rules that Roomzy may have created, as well as to comply with any applicable laws, regulations, or legitimate government requests. Any material uploaded to or posted on the website may be edited, removed, or refused to be posted by Roomzy at its sole discretion. Notwithstanding the above, Roomzy shall have the right, at its sole discretion, to remove any content that it deems to be objectionable or in breach of these terms.
Indemnification
By using Roomzy or User's Account, User undertakes to defend, indemnify, and keep harmless Roomzy, its affiliates, and each of their respective directors, officers, employees, and agents from and against any and all claims and expenses, including attorney fees.
Termination
This Agreement may be terminated at any time by Roomzy or the User. In the event that the user engages in behavior that Roomzy, in its sole discretion, deems undesirable or in the event that the user breaches any of the terms of this agreement, Roomzy shall have the right to immediately terminate the user's account.
Intellectual Property
Regarding its trademarks and logos, as well as any content that Roomzy posts on the Website, all copyrights and trademarks are owned by Roomzy, and all rights are reserved.
Miscellaneous
The parties' full agreement about the subject matter of this agreement is included in this agreement and any operating guidelines for Roomzy that Roomzy may establish. It supersedes all prior written or oral agreements between the parties regarding the subject topic. The laws of India shall apply to the interpretation of this Agreement.
